Acceptance of the terms of use
MOOVE INC. (MOOVE), is an incorporated company in Canada, located at 502-760 Chemin Marie-Le Ber, Montreal, QC, H3E1W6 Canada. MOOVE is the owner and administrator of the website www.moove.store.

This User Agreement (the Agreement) sets out the terms of access and use of the “Website”. When you visit and use the “Website”, you agree to be bound by the terms of this agreement. If you do not agree to these terms, your sole and exclusive remedy is to stop using them.

Anything posted or otherwise accessible through the “Website” including, but not limited to, articles, text, photographs, images, illustrations, audio clips, video clips, software and codes (collectively, content) are protected by Canadian and foreign laws, including copyright, and are owned by MOOVE.

MOOVE makes no representations or warranties as to the “Website” and the « Content, including, without limitation, any representation or warranty:

  1. As to the accuracy, completeness, reliability, timeliness or appropriateness of the “Website” and / or the content;
  2. As to the operation of the “Website” without interruption or error;
  3. For the correction of defects or errors in the “Website”;
  4. For the absence of viruses or harmful elements in the “Website”; and

Limitation of Liability
Subject to applicable law, MOOVE and its officers, directors, employees, agents or their respective successors and assigns shall in no event be liable for any special, indirect or incidental damages of any kind whatsoever. Including any loss or damage to nature or loss of business, loss of savings, loss of data and / or loss of profits and whether or not it is based on a contract (including a breach of an essential obligation), civil liability (including negligence) or otherwise, in excess of one hundred Canadian dollars ($ 100 CAD), even if MOOVE knew or ought to have known of the possibility of such damages.

MOOVE will in no way be held responsible for any loss or damage arising from its failure to protect your user code, password or account information.

MOOVE expressly disclaims any liability for the acts, omissions or conduct of any third party user of the “Website” and shall not be liable for any prejudice, loss or damage (including special damages) indirect or incidental) or expenses arising in any way from: i) the acts, omissions or conduct of a third party user; and ii) the use or inability to use anything, software, content, goods or services of a site or offered through a site linked to the “Website”.

You hereby release MOOVE and its officers, directors, agents and their respective successors and assigns from any damages you may incur and agree not to assert against them any claim arising out of your purchase or use of products or services offered through the “Website”, in particular by third parties.

MOOVE does not wish to be linked to any third party site i) that contains, displays or transmits any unlawful, threatening, abusive, defamatory, obscene, vulgar, pornographic, blasphemous or indecent information of any kind, including in particular, any content constituting or encouraging conduct that would constitute a criminal offence, would give rise to civil liability or would otherwise be a violation of any local, state, provincial, national or international law or regulation that is likely to impair or to interfere with the activities, businesses, credibility or integrity of MOOVE Inc. or that contains, displays or transmits any material or information of any nature that promotes racism, sectarianism, hatred, or any form of bodily harm against a group or person, which could be detrimental to minors, which aims or advocates harassment of another person, offering sexual or violent material in which minors are exploited, giving instructions on unlawful activities, including, but not limited to, the manufacture or purchase of illegal weapons; or (ii) that contains, displays or transmits any information, software or other material that violates or infringes the rights of others, including material that constitutes an invasion of privacy or the rights of personality protection, or is protected by copyright, trademark or other proprietary right.

MOOVE reserves the right to prohibit or refuse to accept a hyperlink to the “Website”, including, in particular, a hyperlink that contains or offers content or information of the nature referred to above, any time. You agree to remove any hyperlinks you may have to MOOVE’s “Website” upon request.

Software and Property Licenses
All software integrated in the “Website” belongs to MOOVE or to the parties recognized as owners. You are hereby authorized to access and use the software incorporated into the “Website”, subject to (i) the terms of this agreement and (ii) other terms of access to and use of such software. You acknowledge and agree that the price of products and services may change without notice and that products and services are subject to availability. If the goods and services are entered at an incorrect price due to a typographical error or an error in the pricing information, MOOVE, at its absolute discretion, has the right to any time after receiving your order, to refuse your order.

You agree to hold MOOVE Inc. and MOOVE and its officers, directors, employees, agents, licensors and their respective successors and assigns harmless and entitled to take them as to all claims, claims, liabilities, costs or expenses of any kind, including, without limitation, legal fees and disbursements resulting directly or indirectly from: i) the violation by you or any of the terms of this agreement; ii) your visit, use or inability to visit or use the “Website” or any site to which the “Website” is or may be linked from time to time; iii) your use of publications, communications, distributions or downloads of any kind via the “Website”, or because you have relied on them; and / or (iv) your violation of the law or regulation.

In order to use certain features of the “Website”, you may be required to register. You agree to i) provide truthful, accurate, up-to-date and complete information about yourself that you are asked to provide in a registration form; and ii) maintain and update the information you provide promptly to keep it true, accurate, current and complete. If MOOVE has reasonable grounds to believe that this information is false, inaccurate, out of date or incomplete, it has the right to suspend your right to visit and use the “Website” (or part of it) or terminate it. MOOVE’s use of any personally identifiable information you provide to it as part of the registration process is governed by the terms of the web-based privacy practices.

In order to use certain features of the “Website”, you may also need a username and password that will be provided to you upon completion of the “Website” registration process. It is your responsibility to maintain the confidentiality of the password and account, and you are responsible for all activities performed by means of your password or account. You agree to notify MOOVE immediately of any unauthorized use of your password or account or any other breach of security, and to ensure that you sign out from your account at the end of each session. MOOVE will not be responsible for any loss or damage arising from its or your failure to protect your password or account information.

Moove may at any time, without notice, in its absolute discretion and without cause, terminate your right to visit and use the “Website” (or part of it). It may also terminate your right to visit and use the “Website”, or part of it, if you fail to comply with any of the terms of this agreement.

Applicable Law and Jurisdiction
When you visit or use the “Website”, you agree that all matters relating to your visit or use of the “Website” and / or the content are governed by the laws of the Province of Quebec and the laws of Canada without the principles of conflict of laws. You agree and hereby acknowledge the non-exclusive jurisdiction of the Federal Court of Canada and / or the courts of the Province of Quebec on these matters. You agree that the provisions of the United Nations Convention on Contracts for the International Sale of Goods do not apply.
